This book brings together the series of articles that Manuel Amarilla has been publishing since 2006 in the e-newsletter “Eupharlaw News”, in the sections “ Galería de Cronopios, Famas y Esperanzas en el Sector Farmacéutico ” (1998-2007), and “ Reflexiones con Wynton Marsalis ” (2008).
On this occasion, Manuel Amarilla surprises us with a particular vision of the pharmaceutical sector, influenced by the writings of Cortazar and Jazz. Both these central themes accompany the reader throughout a series of articles where we find the issues and characters that have marked the work of Manuel Amarilla and of Eupharlaw in the pharmaceutical industry over the last 11 years. The current lack of co-liability of stakeholders participating in the medical chain with respect to the pharmaceutical information provided by them to the citizen and other shortcomings of the industry, have lead Manuel Amarilla to openly express his opinion in a critical and constructive manner, seeking to spark debate on the possible means to remedying such shortcomings, which not only specifically affect the world of medicine, but also affect our health in general .

The right to information on Food Health

The primary objective of this work is to ascertain the scope of food information and to raise the issue of the right of each individual to receive such vital information, as well as the co-responsibility of all those persons engaged in the sector to provide it. This theory, which is developed throughout the work, is clearly defined in the first chapter, written by Manuel Amarilla and Nuria Amarilla. The reporting by public authorities of food risks, the importance of information regarding the prevention of food-related problems such as obesity, the need to include food information in health policies and educational syllabuses, the need to be aware of what we are eating in order to enjoy a healthy and balanced diet, and the requirements that must be met by so-called “borderline products” –products that fall halfway between food products and medicines-, are some of the issues that are addressed in this monograph. In the light of the recent publication of the EC Regulation on nutritional and health claims made on foods the significance of this work is unquestionable.

Mother and child health. From the Stone Age to genetic engineering

This work, written by Doctor Sagrario Mateu –regular collaborator of Eupharlaw- sets out technical issues relating to the health of women and children from prehistoric times until the present day. It alerts us to the need to persevere in the fight against mother and child mortality and to continue preventing congenital malformations. No solution has been found for some areas due to current tobacco and alcohol consumption habits or nutritional deficiencies during pregnancy, such as insufficient levels of iodine and folic acid. New concepts are emerging such as pre-conception preventive measures, child health control, the prevention of unwanted pregnancies in adolescents and new health needs. The author of this work promotes greater information and asks us to place our hopes in education and freedom of thought. Such information is closely related to health education and the vindication of rights, including the right to health and health information, and the right of each individual citizen to equal opportunities and autonomy irrespective of their gender.

The Mature Minor: Reproductive Health and Emergency Contraception (Revised Version)

The success of the monograph published by Eupharlaw and Chiesi Spain in 2004 has led its author, Manuel Amarilla, to propose this new revised edition which includes two new sections. The first section sets out some of the issues that have been raised since the first publication regarding the dispensing of the morning-after pill, and the second section looks at justifications for its free dispensation. Furthermore, its presentation has been enhanced with explanatory tables and charts –highlighting some of the most important points -, thereby making it easier to read, as well as a bibliography and articles by Eupharlaw related to the issue of the mature minor and reproductive health. A website with information for young people is also provided as an additional help tool (www.tedigoymecuentas.com), which was set up by Chiesi and Eupharlaw this year.

Therapeutic Information Direct to the Citizen (TIDC)

On this occasion the author and chairman of the European Pharmaceutical Law Group (Eupharlaw), Manuel Amarilla, focuses on examining the first right included on Eupharlaw's List of Ten Fundamental Health Rights: the right to therapeutic information. The book looks at a new term for such information, namely,Therapeutic Information Direct to the Citizen, and encourages us to engage in a social debate in which many are already involved. It analyses the legal implications of failing to confer this right to therapeutic information on citizens, and provides the reader with insight into the ideas and theories set forth in legal publications on this current legal, administrative and social issue. Information gives greater autonomy to citizens, but it also makes them co-liable for any actions that are taken in connection with their health. Access to and a greater understanding of medical information is essential for enabling citizens to take decisions freely regarding the consumption of medicine, bearing in mind that the basic source of this information is the pharmaceutical industry. TIDC endeavours to raise awareness regarding the right of citizens to request accurate and sufficient medical information, and to seek that every person involved in the medical chain assumes proportional liability for the therapeutic information they provide.

Personal Therapeutic Data (PTD)

In the words of Manuel Amarilla, "within the area of medical treatment, Therapeutic Information (TI) is information produced by the Pharmaceutical Industry subject to the supervision of the Health Authorities that is used by doctors through prescription or pharmacists by means of suitable advice”. The author, Francisco Almodóvar, defines Personal Therapeutic Information (PTI) as "information concerning identified or identifiable individuals who require persons involved in the life cycle of the medicine to obtain suitable, accurate and reliable Therapeutic Information”. The book also looks at other related areas such as Radiofrequency Identification technology (RFID), CRM, etc., which are already bringing us closer to Aldous Huxley's “happy world” and Orwell's universe, which not long ago seemed completely out of reach. The significance of biobanks, cell and gene therapy and progress in neuroscience and assisted reproduction, coupled with the promotion of greater medical information for young adults and the interaction of pharmaceuticals with food stuffs, will require that citizens are sufficiently informed so that they may defend their fundamental rights, in particular, their right to data protection.

Iodine and Health Matters in the 21st Century

Any degree of iodine deficiency affects the proper functioning of the mother's thyroid and also the newly born child. A general lack of knowledge regarding this issue, as well as the restrictions imposed in some areas of the health sector, led Eupharlaw to call together a multidisciplinary group of experts to draw up the paper “Iodine and Health Matters in the 21st Century”. On 7 July 2003, during its II Conference, Eupharlaw presented this work which was coordinated by the Head of the Department for Woman and Child Health Affairs of the Spanish Ministry of Health and Consumption, Dr. Sagrario Mateu. Based on the premise that every child should be entitled to an adequate dosis of iodine to ensure their normal development, and that every mother should receive enough iodine while pregnant to ensure the optimum mental development of her child, this work responds to the need of citizens to be furnished with information regarding their health rights and other related rights.

Reproductive Health and Emergency Contraception for the Mature Minor

Prevention should emanated from information on and access to contraceptive methods, in particular, emergency contraception. This is the conclusion reached by the chairman of Eupharlaw, Manuel Amarilla, in this work sponsored by the Spanish Ginecology Association (SEGO) and the Spanish Association for Contraception (SEC). This publication responds to the need to address this basic health issue from the perspective of the new information needs of citizens, and in particular, the needs of young adults and minors. A young adult is able to take decisions regarding their health when they fully understand the information available to them and are equipped with a level of reasoning that allows them to ascertain the risks involved and their future consequences, except in those cases where they are incapable of doing so due to their psychological immaturity or on physical or mental health grounds. Health professionals, in particular doctors and pharmacists, should develop their preventive approaches regarding the sexuality of the young adult.

Health Rights in the 21st Century

This monograph, which sets forth ten basic health rights, is the result of the efforts of the Working Group on Health Rights created at Eupharlaw in 2003. This group was entrusted with addressing the issue of the citizens´ health rights from a multidisciplinary perspective. Its multidisciplinary nature implied the participation of both expert lawyers and journalists, and of course, professionals from the pharmaceutical and health sectors. The fundamental idea behind this work is that the citizen of the 21st century must be aware that they have certain health rights and are able to demand from all health professionals engaged in the sector the necessary action for ensuring that these rights are respected. In addition, the citizen must also assume responsibility for their own health and participate actively in the decisions affecting them. To this end, it is essential that all those involved in providing information on health matters furnish accurate and comprehensive information so as to allow the citizen to freely and consciously give their consent when facing problems of health and well-being .

Therapeutic Contractual Liability in the 21st Century

Therapeutic activities comprise five fundamental phases: research, manufacturing, authorisation and supervision, prescription and dispensing. The authors of this monograph, Manuel and Nuria Amarilla, address the issues of contractual liability that arise in each of these phases of the life of a medical product, where no single agent in the chain assumes more liability than may be guaranteed by their activities, but where no agent may avoid liability. In this sense, in the words of the chairman of Eupharlaw, all the relationships entered into between those engaged in the pharmaceutical sector and the citizen-patient-user, must have a contractual nature and imply specific obligations between the different stakeholders (including the citizen), depending on their different levels of participation in the therapeutic and medical information chain.

Eupharlaw Newsletters

The European Pharmaceutical Law Group may send its clients and collaborators a newsletter summarising the main events and developments in the pharmaceutical sector gathered from a wide range of general and specialist publications. The newsletter is published from Monday to Thursday and subscription is free of charge when received via e-mail.

In addition, this year Eupharlaw has allowed its collaborators to participate in the newsletter, thereby enabling it to offer an open discussion forum in which professionals may participate, giving their opinions on the matters currently of most concern in the sector.

Pharmaceutical Reengineering

Manuel Amarilla, Chairman of Eupharlaw, has contributed to this Pharmaceutical Handbook, of which 2 editions have already been published. The objective of the Handbook, coordinated by Dr. Marcelo Peretta, Vice-Chairman of the Colegio Oficial de Químicos Farmacéuticos de Buenos Aires (the Official Association of Chemical Pharmacists of Buenos Aires), is to contribute to the discussion on the best way to improve individual health care, based on the recommendations of the top health companies. The responsibilities of the pharmacists raised are of an ethnical/professional nature, but these may very soon become obligations of a legal nature, as knowledge always precedes legislation or is the cause of new legal developments. In this specific case, reengineering will be contingent upon the “forces of change” that favour pharmaceutical care being greater than the “obstacles” which prevent such change. The new mission of pharmacists is to give pharmaceutical care, viewed as the “direct interaction between the pharmacist and their patient, which aims to provide them with a medicine and find, identify, prevent and solve the actual or potential problems related to the use of such medicine or other medicines”. This book sets out the foundations and principles of modern pharmaceutical care and provides practical examples for successfully implementing such care.

Legal aspects of gynaecology and obstetrics

Manuel Amarilla, Chairman of the Eupharlaw, has contributed the first article of this brief monograph, which brings together the papers that were giving on 17 March 2004.

The aim of the meeting was to discuss the fact that the clinical relationship between doctors and patients has changed. As a result of the introduction of the Spanish Law 41/2002, progress has been made with regards to the Principle of Patient Autonomy, leaving behind the Principle of Beneficence, which until now has driven the relationship between doctors and the patients. Furthermore, the concept of public medicine is construed as a public service, similar to any other service provided by the Estate to citizens. Therefore, the obligation arises to ensure a successful results.

Within this new framework, Manuel Amarilla stresses that we need to properly implement and protect the rights set forth in the List of Ten Basic Health Right, in particular the right to therapeutic information.
